I live next to a pub ( No it's not as good as you all think!)
Their car park is next to my fence and garden, The fence is expensive steel to keep the piss heads out and holds up to 120mph winds, 10yr garantee and powder coated, so no painting!!! :grin:
People using the pub are hitting it with their cars, I have cctv around the garage, can I use this recording to pass onto the police to recover the monies or should I just go smash **** out of there cars when they return??

I'll be asking the pub to display signs that if Damage occurs and details are not passed onto the landlord or myself that I will Prosecute.

Also could I ask the brewery to modify their carpark to stop this happening or is it down to the landlord?

Your help would be helpful!
 
I'm no legal boff for a start...sorry, but I would imagine if the fence is on your property and you can prove it has been damaged by people using the pub, the pub will be liable, as they provide the facility for parking, on their private land.
I know a few pub/land borders like the one you're describing and in all of them the pub has put a barrier before the fence to stop it being clattered.
 
The landlord will be a doubtfull help, I'm sure it's ready to shut again for the 6th time in 3 years!
