I don't see why the food places should be made to be responsible for the litter, it's people and a lack of care/responsibility that's the problem.
Do car manufacturers get fines when people are caught speeding in cars they made? If they did you could guarantee cars would be speed limited.
That said, charging extra for the disposable packaging might be the way to go, kinda like the carrier bag charges in supermarkets. You don't pay as much if you bring your own container and the charge from the disposable stuff goes funds dealing with the litter etc.
